Kazneni postupnik

Josip Šilović

"Criminal Procedure Code", the 12th volume of the "Croatian Laws" edition, edited by Josip Šilović, is the official commentary and text of Austro-Hungarian criminal procedural law with additional laws on the press and jury trials.

The Criminal Procedure Code of 17 May 1875 and the laws of 17 May 1875 on the use of the press, on the compilation of jury directories and on criminal procedure in the proceedings of the Seven Courts and the Supreme Court in Vienna is an important legal publication edited by Dr. Josip Šilović (1858–1939), a prominent Croatian lawyer, university professor and rector of the University of Zagreb.

The book was published in 1909 and is the third, amended edition. It contains the full text of the Criminal Procedure Code (Criminal Procedure Code) from 1875, which was valid in Croatia and Slavonia within the Austro-Hungarian Empire, and three accompanying laws in the same field:

  • The Law on the Consumption of the Press
  • The Law on the Compilation of Jury Lists
  • Provisions on Criminal Procedure before the Table of Seven and the Supreme Court in Vienna

Josip Šilović edited the book with comments, explanations and instructions for practical application, which made it a practical manual for judges, attorneys, lawyers and law students. The work was intended primarily for legal practice in Croatia and Slavonia and for a long time served as a standard edition of criminal procedure law.

At a time when Croatia had limited autonomy within Hungary, such editions were of great importance because they enabled local lawyers to work with valid laws in the Croatian language. Šilović was one of the most prolific editors of legal texts of his time and later edited other important legal works.

The book is written in a clear legal style, with precise interpretations of individual articles. Today it represents a significant source for the history of Croatian law, especially criminal procedural law in the Austro-Hungarian period.
