Krivično pravo: Krivično djelo i njegovi elementi
The book represents a fundamental work of Croatian criminal law science. Although published more than three decades ago, its theoretical elaboration is still relevant for understanding the fundamental concepts of criminal law.
In the book, the author analyzes in detail four key elements of the formal concept of a criminal offense:
Action – described as human behavior that can be an action or omission, which is relevant for criminal law assessment.
The essence of the criminal offense (Tatbestand) – refers to the legal description of the offense, emphasizing the importance of a precise normative definition in order to ensure legal certainty.
Illegality – denotes the inconsistency of the action with the legal order, excluding situations when there are circumstances that exclude illegality, such as necessary defense or extreme necessity.
Guilt – implies the perpetrator's psychological relationship to the offense, including intent (dolus) and negligence (culpa), and is crucial for the individualization of criminal responsibility.
Novoselec emphasizes that these elements are interconnected and that their cumulative presence makes the offense criminal. The book also considers special assumptions of criminality, stages of the offense, participation, and concurrence and prolonged offense, providing a comprehensive insight into the structure of the offense.
The book is especially useful for law students, lawyers, and anyone who wants to deepen their knowledge of criminal law institutes.
